In our pursuit of improving user experience and fostering a mutually beneficial partnership on the DRIVE app, there have been recent updates to the Terms of Service by its management, Wahdah Technologies Sdn Bhd. It involves amendments to existing clauses and the introduction of new ones. Please refer to the updated Terms of Service provided below:
1. Fit-to-Share (Clause 11)
We have introduced a new section, “Fit-to-Share,” which emphasizes the commitment of DriveHosts to maintain their shared fleet of vehicles to an optimal operating standard. This commitment includes:
- Operating Standard (Clause 11.1): Ensuring each vehicle adheres to a set operating standard before sharing, including regular maintenance checks and addressing any issues that may compromise safety or functionality.
- Cleanliness (Clause 11.2): Presenting clean and well-maintained vehicles through regular interior and exterior cleaning for a comfortable and hygienic environment during lease transactions.
- Functionality (Clause 11.3): Ensuring vehicles are fully functional and operational at all times, addressing any mechanical or technical issues promptly to avoid disruptions.
- Safety (Clause 11.4): Verifying that vehicles do not pose hazards to customers, including checking the proper functioning of safety features.
2. Cancellation of Booking (Clause 17)
We have updated the cancellation policy to provide clarity and fair compensation for DriveHosts in various scenarios:
- Customer Cancellation (Early or Less than 24 Hours Before - Clause 17.1): DriveHosts will be reimbursed based on principles outlined in this policy, ensuring continued business opportunities on the DRIVE platform.
- Cancellation by WAHDAH via DRIVE (Clause 17.2): DriveHosts will be compensated according to this policy for cancellations due to customer non-compliance or transaction disagreement. In case of DriveHosts inadequacy, points reduction may be imposed.
- DriveHosts Cancellation (Clause 17.3): Points deduction may be applied for early and late-stage cancellations based on severity and frequency to maintain reliability.
3. E-Inspection and Fleet Management (Clause 18)
To enhance compliance and accountability, we have introduced specific clauses related to E-Inspection and Fleet Management:
- DRIVE E-Inspection Compliance (Clause 18.1): DriveHosts are responsible for ensuring full compliance with the DRIVE E-Inspection policy throughout the entire lease period.
- E-Inspection Responsibilities (Clause 18.2): DriveHosts must conduct E-Inspection themselves when personally serving vehicles to customers, ensuring accurate documentation.
- E-Inspection by DriveHeroes (Clause 18.3): DriveHosts are accountable for ensuring thorough and accurate E-Inspection by DriveHeroes during pickup and/or return of vehicles.
- Consequences of Non-Compliance (Clause 18.4): Non-compliance with the E-Inspection policy may result in the withholding of payment and/or reimbursement by DRIVE, and may lead to rejection of claims in case of disputes or discrepancies.
- Fleet Management Records (Clause 18.5): DriveHosts are responsible for maintaining comprehensive records of their fleet history, including service history, service reminders, meter history, and renewal reminders for insurance and road tax.
- Proactive Approach (Clause 18.6): DriveHosts are expected to adopt a proactive approach, actively managing and updating their Fleet records without solely relying on notifications from WAHDAH or DRIVE.
4. Downtime Repositioning (Clause 20.5)
For GE DriveHosts, a new clause has been added to address instances of downtime repositioning. GE DriveHosts acknowledge and agree to bear all costs associated with repositioning GE Vehicles during downtime.
